PROBLEM TO BE SOLVED: To increase a system capacity in relation to a radio transmitter and a radio transmitting method.

SOLUTION: In the radio transmitter and the radio transmitting method a control information extracting portion (105) extracts a CQI number indicating information included in a control information. A receiving quality measuring portions (from 113-1 to 113-n) measure the receiving qualities of respective sub-carriers included in a communicating band. A CQI number producing portion (114) produces CQIs of portions of the sub-carriers whose receiving qualities are good in the communicating band. A multiplexing portion (122) multiplexes the CQIs the number information of the sub-carriers which have produced the CQIs and an ACK signal or an NACK signal. An SC selecting portion (127) selects the sub-carriers having good receiving qualities the number of which has been allocated by the CQI number indicating information sent from a base station.
