PROBLEM TO BE SOLVED: To obtain a transmission diversity effect by applying a CDD while reducing intersymbol interference when performing code multiplexing.

SOLUTION: The transmitter is configured so that when transmitting an Ack/Nack signal using Ack/Nack resources in an uplink control channel from a user terminal to a base station the transmission is carried out from plural user terminals to a base station after multiplexing the code using a code sequence which includes an orthogonal sequence and a cyclic shift sequence. When Aggregation size is determined as larger than 1 based on the Aggregation size which represents the number of control signals of a down control channel the transmitter determines that a resource which is positioned at right-next with respect to an axis of cyclic shift amount of the cyclic shift sequence in an identical orthogonal symbol of the orthogonal sequence is not used. An Ack/Nack signal applied with CDD is transmitted through plural antennas by using a resource ACK#0 allotted to own unit the resource being a resource of a different cyclic shift amount in the identical orthogonal symbols and an un-used resource ACK#1.
