The invention claims a MIMO system which supports multiple spatial multiplexing modes specifically a device used in a wireless MIMO communication system and using method thereof wherein the method comprises selecting a first user terminal to transmit data in the first transmitting gap; selecting one first space multiplexing mode for the first user terminal; selecting a second user terminal to transmit data in the second transmitting gap; selecting one second space multiplexing mode for the second user terminal in which at least one of the first and second spatial multiplexing modes is operated space multiplexing mode; using the first space multiplexing mode to dispatch the first user terminal which transmits data in the first transmitting gap; and using the second space multiplexing mode to dispatch the second user terminal which transmits data in the second transmitting gap.
