The invention claims a method and system for a HARQ protocol. in the method for HARQ protocol the mobile station to perform the following operations: receiving the system broadcast signalling wherein said system broadcast signaling defining a set of parameters and wherein the set of parameters is time division duplexing downlink/uplink (TDD DL/UL) function of the frame than the first packet transmission on the DL sub-frame is received from the base station wherein the first packet transmission is one packet transmission or retransmission and a first packet transmission in response to the previously received determining a transmitting to said base station a hybrid automatic repeat request (HARQ) acknowledgement/negative acknowledgement (ACK/NAK) of timing wherein the timing is based on can be inferred by the system broadcast signaling.
