A communication system (100) includes a forward link (106) from a base station (102) to multiple mobile units (104) the forward link having multiple shared channels (SHCHs) (109) multiple shared control channels (SHCCHs) (108) and multiple dedicated pointer control channels (DPTRCHs) (107) and utilizes HARQ error control for error detection and error correction. The mobile unit when listening to the DPTRCH uses a SHCCH pointed to by the DPTRCH to demodulate and decode data on the SHCH. Throughput problems may arise when the mobile unit combines and decodes the SHCH data that is intended for a different mobile unit or incorrectly decodes SHCH data that is intended for the mobile unit. In order to improve the data throughput of the system the system employs a flush test (902 904 1004 1008) and an energy detector test (1100 1202) to prevent improperly decoded data blocks from corrupting properly decoded data blocks.
