The invention clams a security capability negotiation method for negotiating the security capability when switching the mobile network comprising the following steps: A the first network requests to be switched to the second network; B the access net entity of said second network selects the corresponding security capability or the access net entity of said second network and the core net entity respectively select the corresponding security capabilities; and C said second network sends the selected security capability to the user equipment UE through said first network. The invention also claims a security capability negotiation system. The invention can avoid the defect that MME (Mobile Management Entity) must inform the security capability of corresponding eNB (evolution NodeB) in a certain way when switching from 2G/3G to LTE (Long Term Evolution) network and the defect that new need for SGSN (Service GPRS Supported Node) is brought in when switching from LTE network to 3G network.
