PROBLEM TO BE SOLVED: To provide a data transmission method according to an ARQ-method with which reliable data transmission is achieved with high data throughput.

SOLUTION: Data are transmitted from a transmitter to a receiver. In a case where a corresponding request exists after transmission of a data packet a repeat data packet is transmitted from the transmitter to the receiver and prior to transmitting bits from the transmitter to the receiver in response to the data packet bit rate adaptation is performed by puncturing or repeating. The bit rate adaptation is performed according to a bit rate adaptation algorithm a bit rate adaptation pattern is signaled between the transmitter and the receiver and a data packet is transmitted by modulation that does not have various kinds of significance for a modulation symbol. Only in high-quality modulation assignment rules about the assignment of bits of the data symbol to the modulation symbol are signaled between the transmitter and the receiver and signaling resources are used for signaling.
