A method and an apparatus for inferring a status report generation time in a mobile communication system are provided to prevent unnecessary retransmission due to an error in an initial reception time by regarding an initial reception time of an HARQ packet as the status report generation time. When a status report generation condition is satisfied during a reception of an ARQ(Automatic Repeat Request) packet from an ARQ transmitter side, a status report generator(740) informs a transmission controller of data to be transmitted. When the transmission controller permits the data transmission, the status report generator generates a status report by referring to a reception status of the ARQ packet by the data transmission permission time. The transmission controller(705) analyzes the status report, informs a stored data amount to a lower layer, receives the amount of data to be transmitted in a next transmission period from the lower layer, and determines the data to be transmitted in the next transmission period. A transceiver(735) transmits the status report to the ARQ receiver side.
