A HARQ transmission apparatus including: a transmission section (100) that transmits, in a first transmission, a sequence of bits including systematic bits and parity bits in a first combination of a redundancy version generated by an encoder, and one of a plurality of 16 QAM signal constellation applications, each 16 QAM signal constellation application being defined for symbols consisting of bits i1q1i2q2, the symbols of said bit sequence being selected such that each symbol includes at least one systematic bit and at least one parity bit, and in a retransmission, all or a portion of said bit sequence in a second combination of a redundancy version generated by the encoder and a 16 QAM signal constellation application, wherein said second combination is different of said first combination and is obtained by redisposing the bits for each symbol, before the application of constellation, for at least one of (i) exchange the positions of i1 and i2 and exchange the positions of q1 and q2 (ii) logically invert i1 and q1, and (iii) logically invert i2 and q2.
