A criterion for polarizing a binary decision that requires unequal protection that uses a measured relationship between signal and interference (SIR). The SIR can be derived from a channel estimate determination. The SIR is compared with a threshold, a threshold that is selected to polarize the decision towards a NACK in position with an ACK determination. The technique is advantageous for providing polarized binary decisions for high-speed downlink (HSDP) packets but can be used for both uplink and downlink applications.
