A method for servicing biasing criteria for binary decisions employed by a BS(Base Station) in wireless communication to enhance protection and a device thereof are provided to use criteria capable of more simply and reliably carrying out decisions, while the criteria can have more reliability than a simple threshold value X. A UE(User Equipment)(12) employs an HSDPA(High Speed Downlink Packet Access) mode transmitted in a TDD(Time Division Duplex) way, and sends communication through a communication channel to a BS(10), and then temporarily stores the communication(S1). The BS receives the communication, and obtains an SIR(Signal to Interference Ratio) of the communication channel based on the received communication(S2). The BS compares the SIR with a threshold value selected to bias to NACK transmission state criteria to display that the received communication is to be retransmitted(S3,S4). If the SIR is smaller than the threshold value, the BS transmits an NACK to the UE(S5).
