A base station (BS) in a wireless communication system for converting to binary decision criteria of an unbalanced protection for bias said wireless communication system is used for receiving a communication from a sender in a given channel and generating the channel signal interference of the channel estimation of the channel estimation device for receiving the channel estimates and generating the communication channel signal-to-interference ratio (SIR) ratio guiding device for receiving a plurality of test signal amplitude given range; a comparator to determine noise and signal-to-interference ratio of each composite signal accuracy and correct the signal of each signal amplitude and instances of incorrect signal and select a greater threshold value used by the individual noise. in order to provide an acceptable number of false ACK condition the comparator through the signal-to-interference ratio is compared with a given threshold value to generate an output the given threshold value is selected to the standard bias is negative acknowledgement (NACK) transmission condition for indication should retransmit the received communication. for receiving an output of the comparator to transmit NACK NACK emitter and ACK transmitter for receiving an output of the comparator to transmit the ACK condition when the SIR is larger than the threshold confirming receipt of an error-free communication. In addition a periodic threshold determining device periodically generates the said given threshold.
