PROBLEM TO BE SOLVED: To provide maximum data transfer rates with minimal H-ARQ transmission failures.

SOLUTION: An embodiment comprises at least one receiver at least one transmitter and a processor. The processor is configured to: receive a plurality of transport block sets in a first transmission time interval; generates negative acknowledgement (NACK) in response to determination that one or more of the plurality of transport block sets require retransmission; receive retransmitted one or more of the plurality of transport block sets in a second transmission time interval; and combine the one or more transport block sets requiring the retransmission according to said determination among the received plurality of transport block sets with the retransmitted one or more transport block sets.
