The user device according to the present invention receives data of a transmission time interval (TTI). Data in this transmission time interval is transmitted using Adaptive Modulation and Coding (AMC). The user equipment utilizes a hybrid automatic repeat request (H-ARQ) mechanism of the physical layer on the data of the received transmission time interval. The user device includes a receiver coupled to the antenna. The receiver receives data of a transmission time interval. Data in the transmission time interval is transmitted in a designated first modulation and coding scheme with a plurality of transport block sets. The receiver receives at least one retransmitted transport block set. At least one retransmitted transport block set is transmitted in a different designated second modulation and coding scheme. The hybrid automatic repeat request decoder is coupled to the receiver and determines whether each data of the transport block set satisfies a specified quality. The hybrid automatic repeat request decoder combines the at least one retransmitted transport block set with the corresponding received transport block set previously. If the specified quality is not satisfied, the automatic repeat request transmitter sends a repeat request.
