A base station according to the present invention transmits data of a transport block set (TBS) using adaptive modulation and coding (AMC), and a hybrid automatic repeat request (H-ARQ) of a physical layer. The transmitter is coupled to the antenna and transmits a set of transport blocks in a designated first modulation and coding scheme. The transmitter may transmit segments of the transport block set. At least two segments are transmitted independently. The automatic repeat request receiver receives the repeat request. The adaptive modulation and coding controller is coupled to the transmitter to change the designated first modulation and coding set to the designated second modulation and coding set. The splitting apparatus changes to the designated second modulation and coding set in response to receiving the repetition request, and divides the transport block set into a plurality of segments according to the splitting information for transmission by the transmitter.
