The user equipment according to the present invention receives data of a transport block set (TBS). The transport block set is transmitted using adaptive modulation and coding (AMC). The user device uses a Hybrid Automatic Repeat reQuest (H-ARQ) mechanism of the physical layer. The user device includes a receiver coupled to the antenna. The receiver receives a set of transport blocks and determines whether the received set of transport blocks satisfies a specified quality. The receiver receives segments of the transport block set on subsequent transmissions. The segment is transmitted using a different modulation and coding set than the transport block set. At least two of the segments are being transmitted independently. The hybrid automatic repeat request decoder is coupled to the receiver and determines whether each received transport block set and segment meets a specified quality. The automatic repeat request transmitter sends a repeat request if the transport block set and segment do not meet the specified quality.
